About Heather Kindness, J.D.

Heather is a dedicated family law lawyer helping clients reach effective and sustainable resolutions.  Her practice encompasses all areas of family law, including: cohabitation and marriage contracts, separation and divorce, parenting time and decision making responsibility, child and spousal support and division of family property.

In her years practicing family law, Heather has litigated at the Ontario Court of Justice, the Ontario Superior Court of Justice, and the Ontario Court of Appeal. She tailors her approach to best serve each client’s unique circumstances and goals. She can move skillfully between negotiation, mediation, and litigation, as required.

Prior to founding Heather Kindness Family Law, Heather worked at prominent family law firms in Toronto. Upon reflection of the negative toll litigation can take on clients and their children, Heather trained as a collaborative family lawyer. She is excited to offer this option to clients, which places them in the driver’s seat of a cooperative and cost-effective process to resolve their family law issues.

Heather was called to the Bar of Ontario in 2015 after graduating with a JD from the University of Toronto Law School (2014). Heather graduated with First Class Honours from McGill University in 2008. Heather has a diverse legal background. Before transitioning to work exclusively in family law, Heather worked on Bay Street for a global firm and then worked internationally for the United Nations with the UNHCR.

Heather is a member of the Canadian Bar Association, the Ontario Bar Association, the Advocates Society, the Ontario Collaborative Lawyers Association, Collaborative Practice Toronto and the Law Society of Ontario.

Areas of Practice

Legal Representation

At Heather Kindness Family Law we are commited to providing comprehensive legal solutions in all areas of family law. We adapt our legal strategy and advocacy style to effectively meet your needs and goals. While we strive for cooperation and collaboration to reach sustainable, cost-effective and child-focused resolutions, we also understand that the court process may be a necessary adjunct to resolving disputes. When the situation calls for it, we are zealous and ethical advocates.

Collaborative Family Law

Collaborative family law is a team based process that aims to settle family disputes without having to go to court. In this process, each party retains a collaboratively trained lawyer and then meets to conduct negotiations face to face with the option of additional assistance from financial and family experts. This negotiation provides parties the opportunity to explore the interests that are most important to them and to fashion creative and “tailor-made” settlements.

At Heather Kindness family Law, we are collaboratively trained to assist in resolving your family law disputes in a manner that preserves the integrity of you and your family.

Domestic Contracts

Domestic contracts, including marriage contracts (or prenuptial agreements), cohabitiaton agreements, separation agreements, and parenting plans serve as mutual agreements addressing potential concernes that could occur if a relationship ends or outlining negotiated terms to resolve a family law conflcit following the end of a spousal relationship.

Heather Kindness brings to the table a wealth of experience in formulating and developing intricate agreements to best address each client’s unique needs and circumstance .
